Eugenie Bouchards lawsuit against the USTA could be headed for a jury trial as the first anniversary of the accident that forced her out of the US Open last year approaches.The process has been as slow-moving as Bouchards effort to rebuild her singles ranking.They [USTA officials] were stalling. Now were ready to move. Benedict Morelli, Bouchards lawyer, told ESPN.Chris Widmaier, managing director of corporate communications for the USTA, replied to ESPNs request for a response with an email.Her lawyers asked for an extension, Widmaier said. The USTA on the other hand, has remained ready, willing and able to bring the litigation to a conclusion as expeditiously as is possible whether through settlement discussions or a fully litigated process.There has been some communication between the two sides.They have indicated that they wanted to settle, Morelli said. We didnt talk specific-specific, but lets just say their side of the conversation was unrealistic.Bouchard, once ranked as high as No. 5, was working to emerge from a deep slump when she slipped and fell in the empty, dark physiotherapy room after sitting for a late-evening news conference after a mixed doubles win on Sept. 4, 2015. Cleaners had already swabbed down the floor with what her subsequent suit described as a slippery, foreign and dangerous substance.Bouchard suffered a concussion and was forced to withdraw from the tournament even though she was still in contention in three events: singles (she had won her third-round match that morning), doubles and mixed doubles.She returned to the tour at the China Open at the beginning of October, but retired complaining of concussion-related dizziness during her first-round match while trailing Andrea Petkovic, 6-2, 1-1. It was her last match of the year.Bouchard, now 22, was ranked No. 7 at the start of 2015, following a year in which she reached her highest ranking and two major semifinals and the Wimbledon final. But her game began to slip in the spring, and she would never recapture her commanding form with any consistency after falling out of the top 10 in June of 2015. By the time she fell at the US Open, she was down to No. 25.Starting fresh this year at No. 49, her ranking declined to a low of No. 61 in late February before it began a gradual rise to its present No. 40. Bouchard has played 50 matches in 2016 and has retired from just one match (with an injury unrelated to her fall). In May, she reunited with her coach at her peak, Nick Saviano.Morelli said he plans to begin taking depositions in advance of a trial shortly after the US Open. He accused the USTA of trying to escape its obligations on the cheap.Its interesting that they dont want to take care of their own, Morelli said. Berger went close more than once in his debut season, notably losing a play-off to Padraig Harrington in Florida, and his 10th-placed finish in this event is a key pointer towards his chances. Berger has dropped back out of the worlds top 50 after a disappointing start to the year The Rookie of the Year ranked seventh for distance and 10th for greens on his first competitive outing at Scottsdale, and his make-up is very much similar to Koepka - hes a modern-day powerhouse who is suited to these low-scoring conditions.Berger missed the cut last week but that may prove a blessing in disguise, as the rest of the field had to battle Torrey Pines at its toughest. Playing in 40mph winds can knock anyone off their stride and in benign conditions, those who were involved into Monday may well be at a disadvantage.Prior to that, Berger had produced four under-par rounds to start the year in the Sony Open and he can kick on with a strong performance with those fond memories to call upon from 2015. Mickelson impressed on his return to action at PGA West but struggled last week Players with Arizona ties have done really well here and Phil Mickelson, who attended Arizona State, could replicate his 2013 win in which he came so close to shooting a magical 59 in the first round.There were good and bad signs last week as he somehow missed the cut, but as mentioned that could turn out to be an advantage and the way hes been driving it, his brilliant wedge game will have the chance to shine.Granted, Mickelson hasnt been the force of old for a while but having led the field in strokes-gained tee-to-green two wweeks ago, his long game is really healthy and having won this title three times I envisage a strong title challenge this week.dddddddddddd. Hes preferred to Kevin Na, who really should go well and has the required wedge stats to make for a compelling case. Unfortunately, Na is hard to get over the line and on this occasion Ill leave him out.Matt Jones is a much better bet as another Arizona resident whose recent form looks solid, dating right back to his victory in the Australian Open last December. Jones won on home soil late last year at the Australian Open Jones opened 65-65 here in 2014 to show that he can score at the course where he practices, and his victory in the Shell Houston Open came at a similar layout.Like Berger, he ranks very highly in the wedge proximity stats and it was that formula which led me to 2012 champion Kyle Stanley, so its worth sticking with.Finally, although Patton Kizzire, Kevin Streelman, Tony Finau and Jonas Blixt all merit close inspection, Im heading back towards the top of the market to ride the hot hand with Jason Dufner. Dufner ended a long run without a win at the CareerBuilder Challenge Yes, its rare for players to win two starts in a row but Dufner played beautifully to win the CareerBuilder Challenge, played on three resort-style, desert golf courses not dissimilar to Scottsdale.Prior to that hed bagged a pair of top-10s and this improvement can be traced back to the Franklin Templeton Shootout which he won alongside Snedeker last December.Seeing Snedeker win can only boost Dufner further but the most compelling evidence for him going close is the fact he won twice in three starts when making his breakthrough in 2012.Given that hes been a play-off loser here before and is a proven, top-class winner at his best, that makes Dufner a play at 33/1.Watch the Phoenix Open throughout the week live on Sky Sports 4 - your home of golf.
